Your agreement
The HCISD Hub is a technology resource of Harlingen Consolidated Independent School District. By creating an account, signing in, or submitting anything through the Hub, you agree to these Terms of Use, to the Community Guidelines, and to the Privacy Notice.
District policy requires members of the public who are given access to District technology resources to acknowledge the rules governing that access and to agree to allow monitoring of their use (Board Policy CQ(LOCAL)). Your sign-in is that acknowledgment. District policy allows this acknowledgment to be given electronically (Board Policy CQ(LOCAL), Electronically Signed Documents).
If you do not agree, do not use the Hub.
Access is a privilege, not a right
District policy states plainly that access to District technology resources is a privilege, not a right (Board Policy CQ(LOCAL)). Access to the Hub may be limited, suspended, or ended at any time, with or without notice, and the District may refuse access to any person.
Public access is offered on the condition that it imposes no measurable cost on the District and does not unduly burden District technology resources (Board Policy CQ(LOCAL)). Members of the public with access must comply with all District rules, regulations, and policies governing appropriate use.
Who may use the Hub
- Accounts are for adults. Do not create an account if you are under 18.
- Use your real name and a working email address.
- Keep one account. Do not create an account for someone else or impersonate anyone.
- You are responsible for what happens under your account, including anything submitted from it.
- The Hub does not offer student accounts and does not offer direct messaging with students. District policy restricts employee electronic communication with currently enrolled students and bars the use of personal platforms for it (Board Policy DH(LOCAL)).
Volunteers and Community Partners are not part of this launch. When those sections open, separate terms will apply to them and we will publish those terms before anyone can sign up.
Your use is not private and may be monitored
District policy provides that electronic mail transmissions and other use of District technology resources by students, employees, and members of the public are not considered private, and that designated District staff may monitor use at any time (Board Policy CQ(LOCAL)).
Treat everything you do on the Hub as reviewable by the District and, in many cases, as a record that can be requested by the public. See Records and public information in the Privacy Notice.
What you may not do
The Community Guidelines set out the conduct rules in full and are part of these terms. In short, do not harass, discriminate against, threaten, or defame anyone, do not post unlawful or obscene content, do not spam or solicit, do not post another person information without permission, do not post about identifiable students without District approval, and do not attempt to break, probe, or overload the Hub.
Content you submit
You keep ownership of what you write and the photos you upload. By submitting content to the Hub you grant the District a non-exclusive, royalty-free, worldwide license to store, reproduce, adapt for format, publish, and display that content on the Hub and in District communications about the Hub. You can end that license going forward by removing the content or asking us to remove it, subject to the records rules described in the Privacy Notice.
You promise that you have the right to submit what you submit, including the right to any photo you upload and the permission of any recognizable person in it.
The District retains final editorial authority over what appears on the Hub. We may decline to publish, edit for length and format, or remove anything, at any time, for any reason consistent with District policy. Publication is never automatic and is never a guarantee.
Impact causes, fundraising, and giving links
The Impact section lists causes that support District students, campuses, and programs. It is not a payment system. The District does not process donations through the Hub.
- Approval comes first. A District employee who solicits web-based donations, including crowdfunding, must obtain prior approval from the employee's supervisor before using the name or image of the District, a campus, or any student (Board Policy CDC(LOCAL)). No cause is published on the Hub until the required supervisor or principal approval is documented.
- Funds solicited for the District belong to the District. All donations solicited on behalf of the District become the sole property of the District (Board Policy CDC(LOCAL)). Routing a gift through an outside platform does not change that.
- Giving links leave the Hub. A cause may include a link to an outside giving page. That page is operated by a third party the District does not own or control. We do not receive, hold, or reconcile funds on those pages, and we are not responsible for their terms, fees, security, or tax treatment.
- Listing is not endorsement. Acceptance of a listing does not constitute District approval or endorsement of the cause, the platform, or any product or service mentioned (Board Policy GKB(LOCAL)).
- No political advertising. The District does not accept paid political advertising (Board Policy GKB(LOCAL)), and the Hub may not be used for political advertising, campaign communications, or electioneering.
- The Hub is not a public forum. District policy provides that advertising is accepted solely to generate revenue for the District and not to establish a forum for communication, and that the District retains final editorial authority to accept or reject submissions (Board Policy GKB(LOCAL)).
- Support organizations and student fundraising. Parent, booster, and support organizations must notify the principal or appropriate administrator before fundraising (Board Policy GE(LOCAL)), and fundraising that involves students requires administrative approval and must relate to the educational mission (Board Policy FJ(LOCAL)).
District names, logos, and trademarks
All copyrights, trademarks, and other intellectual property rights belonging to the District remain with the District at all times, and use of District intellectual property is limited to District-related purposes unless the Superintendent authorizes otherwise in writing (Board Policy CY(LOCAL)).
Members of the public, outside organizations, and vendors may not use District trademarks, names, logos, or mascots without written authorization from the Superintendent. Merchandise requires a licensing agreement and may require royalties (Board Policy CY(LOCAL)). See the Copyright and Trademark Notice.
Copyright complaints
If you believe content on the Hub infringes your copyright, follow the process in the Copyright and Trademark Notice, which names the District designated agent for infringement notices.
Other sites we link to
The Hub links to outside websites, including giving pages and district pages that we do not operate. We do not control those sites, we do not endorse them by linking to them, and their terms and privacy practices are their own.
Suspension, removal, and how to appeal
We may remove content, suspend a listing, or end access when a person violates these terms, the Community Guidelines, or District policy, or when the District determines that removal is in the interest of the District or the community.
- Discrimination or harassment. Report it to the Title IX and ADA / Section 504 coordinator, not through the general complaint route (Board Policy FFH(LOCAL)). The coordinator is named in the Community Guidelines.
- Public complaints. A member of the public may file a complaint under Board Policy GF(LOCAL). The complaint must be filed within 15 business days of the event, and it may be filed by hand delivery, by electronic communication, or by U.S. Mail.
- Student and parent complaints. These are filed under Board Policy FNG(LOCAL).
- Refusal of access. If access to District property or resources is refused under Education Code 37.105, the person is given written information explaining the right to appeal through the grievance process, including the right to address the Board in person within 90 calendar days (Board Policy GKA(LOCAL)).
Disclaimers
The Hub is provided as is and as available. Consistent with Board Policy CQ(LOCAL), the District makes no warranty of any kind, express or implied, regarding the Hub, including the availability of the service, the accuracy or quality of information obtained through it, or the preservation of data. The District is not responsible for a user's misuse of the service, for mistakes or negligence by users, or for costs incurred by users.
The District is not responsible for content submitted by others, for outside sites reached from the Hub, or for the outcome of any gift made through an outside giving page.
Limits on liability
To the fullest extent allowed by Texas law, the District is not liable for indirect, incidental, special, or consequential damages arising out of your use of the Hub.
Nothing in these terms waives, limits, or expands any immunity, defense, or limitation on damages available to the District, its trustees, officers, or employees under Texas law, and nothing here creates a contract right that the District has not expressly granted.
Records and public information
What you submit through the Hub is a local government record subject to the District records control schedules and to the Texas Public Information Act (Board Policy CPC(LOCAL)). See the Privacy Notice for how long we keep things and how release works.
Governing law
These terms are governed by the laws of the State of Texas. Venue for any dispute lies in Cameron County, Texas.
Changes to these terms
We may update these terms. The current version is always posted here with its effective date. Continuing to use the Hub after a change means you accept the updated terms.
